Accessing our site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.

From time to time, we may restrict access to parts or our entire site, for Visitors who have registered with us.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether setup by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved from 2003-2016.

Client Complaints Policy   ‍

Analytix Solutions LLC ("Analytix", "we", "us") wants every client to be able to raise concern easily and get a fair, timely answer. This policy explains how to make a complaint, what happens next, how long each step takes, and what to do if you are not satisfied with our response. We also use what complaints tell us to improve our services.

Our commitment   ‍

We handle every complaint according to five principles:

  • Accessible: raising a complaint is simple and free, through the channels listed below.
  • Transparent: we tell you who is handling your complaint, what we are doing, and when to expect an answer.
  • Responsive: we acknowledge, investigate and resolve complaints within the timelines in this policy.
  • Fair: complaints are reviewed objectively by someone who was not the subject of the complaint.
  • Confidential: complaint information is shared only with the people who need it to resolve the issue.


What this policy covers

A complaint is any expression of dissatisfaction with our services or conduct where you expect a response or resolution. This includes concerns about:

  • Quality, accuracy or timeliness of deliverables
  • Communication or responsiveness of our team
  • Billing-related service matters
  • Process gaps
  • Support experience

Any current or former client may raise a complaint.
Routine service requests and questions should go to your usual Analytix contact first.

Terms and Definitions

  • Client: An individual or a company receiving services from Analytix under an agreed contractual agreement.
  • Timeline: The intended timeframe for resolving a complaint. It is not contractual guarantees unless specifically stated in the agreement.  
  • Complaint: An expression of dissatisfaction regarding service delivery, communication, quality or any other aspect of the service.

How to raise a complaint ‍

You can raise a complaint in any of these ways. Every complaint, whichever channel you use, is logged in the same register and handled under this policy.

If your complaint is about your Account Manager, please use email rather than contacting them directly.

To help us resolve it quickly, please include:

  • A clear description of the issue and what outcome you are looking for
  • The service involved and your Analytix point of contact
  • Relevant dates, and any supporting documents

  • Your name, company name and preferred contact deta
    ‍

*Protecting sensitive data: please do not include protected health information (PHI), personal information (PII) or financial account details in email. If your complaint involves such data, say so in your message and we will arrange a secure way to share it.

What happens next ‍

We aim to resolve most complaints within 10 business days. "Business days" means Monday to Friday, excluding US federal holidays, based on US Eastern Time.

Closure and reopening  

  • Acknowledge: Confirm receipt, give you a complaint reference number
  • Investigate: Review records and communications, speak with the team involved, and contact you if we need more information
  • Resolve: Explain what we found, what we will do to put things right, and any steps to prevent it happening again
  • Close: We will notify on the steps that are taken in writing and close the complaint

We close a complaint when we have notified you.
In event additional information required on the complaint, If we do not hear from you within 10together the "Programs"). business days, we will close the complaint. If you disagree with the outcome, you can reopen using the same provided reference number.

Confidentiality, fair treatment and records ‍

Complaint information is shared only with the people who need it to resolve the issue. We handle it in line with our contractual obligations, applicable data protection laws and our Privacy Policy.

Raising a complaint will never affect the quality of service you receive or how our team treats you.

We keep a record of every complaint, the actions taken and the outcome, in line with our data retention and information security policies. We review complaint trends regularly to find and fix underlying causes. More on how we protect your data is in our Trust Center.

This policy does not replace your service agreement. Contractual disputes, legal claims and requests covered by specific contract terms (such as service credits) follow the process in your agreement. It also does not create any additional legal rights, warranties, refunds, service credits, compensation, or obligations beyond what is already agreed with the client.

Accepting a complaint does not mean that Analytix accepts fault, liability, wrongdoing, or breach of contract. All existing contractual terms related to liability, confidentiality, legal requirements, security, and compliance will continue to apply.

Analytix Referral Programs (Terms and Conditions)

Effective date: 1 October 2026

These Referral Program Terms and Conditions ("Referral Terms") are incorporated into the Terms of Use ("Terms") of Analytix Solutions LLC ("Analytix," "we," "us," or "our"). They govern two distinct programs: the Analytix Client Referral Program and the Analytix Affiliate Program (each a "Program," together the "Programs").

By participating in either Program, you agree to these Referral Terms in addition to the Terms of Use. If these Referral Terms conflict with the Terms of Use, these Referral Terms prevail with respect to the Programs.

Existing arrangements.
These Referral Terms do not supersede, amend, replace, or override any existing written agreement, arrangement, or understanding between Analytix and a Participant. That includes any signed Analytix Affiliate Agreement, any referral or commission arrangement agreed under Section 3(h), and any other commercial terms already in place. If these Referral Terms conflict with such an arrangement, the arrangement prevails with respect to that Participant, and these Referral Terms apply only to matters it does not address.

For the purposes of these Referral Terms, the following definitions apply:

  • A "Client Referrer" is an Analytix client participating in the Client Referral Program.
  • An "Affiliate" is a third party approved by Analytix under the Affiliate Program.
  • A "Participant" means either, as the context requires.

1. Eligibility and Participation

a. Client Referrers. The Client Referral Program is available to Analytix clients by invitation only.
‍
b. Affiliates. The Affiliate Program is open to businesses and individuals who apply and are approved by Analytix at its sole discretion. Affiliates do not need to be Analytix clients. Participation requires signing the Analytix Affiliate Agreement. Before any payment is released, Analytix must hold a completed Form W-9, or Form W-8BEN / W-8BEN-E for non-US Affiliates.

c. Dual participation. An Analytix client may participate as an Affiliate only if Analytix has approved that status in writing in advance. Without that approval, all referrals submitted by a client fall under the Client Referral Program. Where dual status is approved, each referral earns under one Program only, as designated by Analytix.

d. Related parties. Referrals of a Participant's own business, subsidiaries, affiliates, or related parties are not eligible under either Program. When submitting a referral, Participants must disclose any ownership, family, employment, directorship, or fee-sharing interest in the referred business. If a Participant fails to disclose such an interest, Analytix may disqualify the referral. The Participant then forfeits any associated reward or commission, whether or not it has already been issued.

2. Referral Process and Attribution

a. Participants may refer potential clients to Analytix by sharing a unique referral link provided by Analytix.
‍
b. To qualify for a reward or commission, the referred client must meet one of these conditions:

  • It uses the provided referral link during sign-up; or
  • The Participant submits it through their portal before it has any other contact with Analytix.

c. First valid submission. Each referral is attributed to the first valid submission Analytix receives, based on the date and time Analytix records.

d. Prior contact. A prospect is not eligible if, at any time between 1 October 2026 (the Programs' launch date) and the date of submission, that prospect did any of the following:

  • Was an Analytix client;
  • Was an active opportunity in the Analytix pipeline;
  • Contacted Analytix directly; or
  • Responded to Analytix marketing.

Analytix's own customer and marketing records decide any attribution dispute.

e. Attribution window (Affiliates). A qualifying referral stays attributed to the submitting Affiliate for 90 days from the date of submission. If the same Affiliate re-submits a prospect it submitted before, that does not start a new attribution window or extend the original one.

f. Analytix may disqualify referrals that do not meet a Program's eligibility criteria.

3. Rewards and Commissions

a. Analytix may provide referral rewards and commissions, at its sole discretion, to Participants who refer new clients to Analytix.

b. Analytix determines the nature and value of referral rewards and commissions, and may change them without notice, subject to Section 5(a).

c. Rewards and commissions are awarded only for qualifying referrals who become paying clients of Analytix. A referred client becomes a "paying client" when it has signed an engagement with Analytix and paid its first invoice in full.

d. Client Referrers. Rewards are issued as a redeemable reward code, such as a gift card. Reward codes cannot be transferred or redeemed for cash. They are issued 60 days after the referral becomes a paying client under Section 3(c). Reward codes are valid for 12 months from the date of issue. Plum's terms and conditions (provided by Xoxoday) also apply and are available at https://www.xoxoday.com/terms.

e. Affiliates — commission. Analytix pays a one-time cash commission of USD $1,000 for each qualifying referral. The commission becomes payable once the referred client becomes a paying client under Section 3(c). The payment method and timing are as set out in the Affiliate's agreement with Analytix, or as otherwise mutually agreed in writing.

f. Affiliates — one commission per client group. Commission is payable only once per referred client and its affiliated group of companies. This holds regardless of how many legal entities, contracts, or service lines are later engaged, and regardless of any renewal or expansion of the engagement.

g. Affiliates — minimum contract value. Commission is payable only where the first-year contract value of the referred engagement is at least USD $1,000.

h. Affiliates — negotiated commission. Where the scope or value of an engagement warrants it, Analytix may, at its sole discretion, agree an alternative percentage-based commission with an Affiliate. Any such arrangement:

  • Applies to that specific case only;
  • Must be agreed in writing and signed by an authorised officer of Analytix before the referral is submitted; and
  • Does not create an entitlement or precedent for any other referral or Affiliate.

i. Assignment and set-off. Commissions are payable only to the entity named in the Affiliate Agreement and may not be assigned to any third party. Analytix may deduct from any amount payable any sums the Affiliate owes to Analytix.

j. Clawback. Analytix may withhold, adjust, or reclaim a reward or commission if a referred client fails to pay or cancels, or if the referral is later found not to have met the eligibility criteria. If the referred client terminates its engagement or stops paying within 3 months of commencement, Analytix may reclaim the commission in full. It may do so by deducting it from amounts otherwise payable, or by invoice payable within 30 days of issue.

4. Rewards and Commissions

This Section 4 applies to Affiliates only.
Independent status. Nothing in these Referral Terms creates a partnership, joint venture, employment, or agency relationship. Affiliates act as independent contractors. They have no authority to bind Analytix, negotiate on its behalf, or make representations, warranties, or commitments about Analytix services, pricing, or delivery timelines.

b. Brand and marketing. Affiliates may use Analytix names, logos, and marketing materials only as supplied by Analytix and in line with the Analytix affiliate brand guidelines. Any custom collateral referencing Analytix requires prior written approval. Affiliates may not:

  • Bid on Analytix-branded keywords in paid search;
  • Register domain names or social handles incorporating the Analytix name; or
  • Represent themselves as Analytix.

c. Conduct and compliance. Affiliates must comply with all applicable laws in promoting Analytix, including anti-spam, telemarketing, data protection, and advertising disclosure requirements. They must clearly disclose their commercial relationship with Analytix wherever they promote its services. The following are prohibited and are grounds for immediate termination and forfeiture of unpaid commissions:

  • Unsolicited bulk email;
  • Misleading claims;
  • Incentivised or automated sign-ups; and
  • Submission of leads obtained without consent.

d. Data protection warranty. Affiliates warrant that any personal data they submit to Analytix was lawfully obtained, that the individual consented to being contacted for this purpose, and that its transfer to Analytix is permitted under applicable data protection law.

e. Confidentiality. Affiliates will keep confidential all non-public information about Analytix, its clients, and referred prospects, and will use it only for the purposes of the Affiliate Program.

f. Non-solicitation. While participating and for 6 months after participation ends, Affiliates will not:

  • Solicit Analytix clients for services that compete with those provided by Analytix; or
  • Knowingly route a prospect submitted under this Program to a competitor of Analytix.

g. Indemnity. Affiliates will indemnify Analytix against all claims, losses, penalties, and reasonable legal costs arising from either of the following:

  • The Affiliate's breach of Section 4(b), 4(c), or 4(d); or
  • Any representation made to a prospect that Analytix did not authorise.

h. Limitation of liability. Analytix's total liability to an Affiliate under these Referral Terms is limited to the total commissions paid to that Affiliate in the 12 months before the claim.

5. Modification and Termination

a. Modification. Analytix may modify, suspend, or terminate either Program at any time. Changes apply prospectively only. Referrals validly submitted before a change takes effect are governed by the terms in force on the date of submission.

b. Revocation. Analytix may revoke referral rewards or commissions if it determines, at its sole discretion, that a Participant has violated these Referral Terms, the Affiliate Agreement, or the Terms of Use.

c. Termination on notice. Either party may end an Affiliate's participation by giving 30 days' written notice. Commissions on referrals that qualified before the termination date remain payable. No commission accrues on referrals submitted after it.

d. Termination for cause. If participation is terminated for breach, fraud, or misrepresentation, no commission is payable on any referral, whether or not it had otherwise qualified. Analytix may also reclaim commissions already paid for the affected referrals.

6. General

a. Taxes. Participants are responsible for any taxes associated with referral rewards or commissions. Analytix will issue Form 1099 to US Affiliates where required by law.

b. Data use. Analytix may use the information Participants provide in connection with the Programs in accordance with its Privacy Policy.

c. No obligation to engage. Analytix has no obligation to accept, pursue, or contract with any referred prospect. It keeps sole discretion over its client relationships, pricing, and scope of services.

d. Governing law and venue. These Referral Terms are governed by the same law, and subject to the same jurisdiction and venue, as the Terms of Use.

By participating in either Program, you acknowledge that you have read, understood, and agreed to these Referral Terms and the Terms of Use.
